Official HRA Exemption Rules Guide

Statutory provisions every salaried Indian taxpayer must know when claiming House Rent Allowance under Section 10(13A).

The Statutory 3-Rule Formula (Rule 2A)

Your exempt HRA is calculated as the minimum of the following three statutory values:

  • 1. Actual HRA Received: Total House Rent Allowance paid by your employer.
  • 2. 50% or 40% of Salary: 50% of Basic+DA if residing in Mumbai, Delhi, Kolkata, or Chennai; 40% of Basic+DA for all other cities (including Bengaluru, Hyderabad, and Pune).
  • 3. Rent Paid minus 10% of Salary: Total actual rent paid during the year minus 10% of your annual Basic Salary + Dearness Allowance.

Key Compliance Thresholds for Salaried Employees

  • ✓ Annual Rent > ₹1,00,000: Landlord PAN is legally mandatory (CBDT Circular 8/2013). If landlord lacks a PAN, submit the Landlord Declaration Form.
  • ✓ Monthly Rent > ₹50,000: Under Section 194-IB, tenant must deduct 2% TDS (reduced from 5% w.e.f Oct 1, 2024) and file Form 26QC.
  • ✓ Cash Payments > ₹5,000: Revenue stamp of ₹1 is required under Indian Stamp Act, 1899 only for Cash transactions. Digital UPI/Bank transfers need no revenue stamp.
  • ✓ Old Tax Regime Only: Section 10(13A) HRA exemption is exclusively available under the Old Tax Regime. The New Tax Regime (Section 115BAC) disallows HRA exemptions.
